Please read these Terms of Use (“Terms”) carefully before using the SUGARED + BRONZED® LLC (“SUGARED + BRONZED,” “we,” “us,” or “our”) website, sugaredandbronzed.com (the “Site”), or purchasing our products and services.

By accessing or using the Site, booking an appointment, or purchasing products, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms include a mandatory arbitration agreement and class action waiver that affect your legal rights. Please read the "Dispute Resolution" section carefully.

1. GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. We reserve the right to revise these Terms at any time by updating this posting. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.

2. TRANSPARENCY IN PRICING (CALIFORNIA SB 478) In compliance with California law, SUGARED + BRONZED is committed to honest pricing. The prices displayed for our services and products include all mandatory fees. Taxes and shipping costs (where applicable) are calculated and displayed separately during checkout. We do not charge hidden "service fees" or mandatory surcharges that are not disclosed in the advertised price.

3. MEMBERSHIPS, AUTO-RENEWALS & CANCELLATIONS If you purchase a membership, pass, or subscription ("Membership") that automatically renews:

  • Consent: You expressly authorize us to charge your payment method at the specified interval (e.g., monthly) until you cancel.

  • Cancellation (Click-to-Cancel): In compliance with California AB 2863, if you signed up for a Membership online, you may cancel it online. You can cancel your Membership at any time by logging into your account on the Site or by emailing customerservice@sugaredandbronzed.com. Cancellation requests will be processed immediately, though you will retain access to your Membership through the end of the current billing cycle.

  • Notice of Changes: We will provide notice of any material changes to your Membership, including price increases, at least 30 days prior to the change taking effect.

4. INTELLECTUAL PROPERTY & AI RESTRICTIONS All content on the Site—including text, images, logos (SUGARED + BRONZED®, Bronzed Sugar®, Bronzedsugar®), graphics, and code—is the property of SUGARED + BRONZED and protected by copyright and trademark laws.

  • License: You are granted a limited, revocable license to access the Site for personal, non-commercial use.

  • Prohibited Uses: You may not reproduce, distribute, display, or sell any content without our express written permission.

  • AI & Data Mining: You are strictly prohibited from using any content on this Site, including product descriptions, images, and pricing, for the purpose of training Artificial Intelligence (AI) technologies, machine learning models, or for data mining, scraping, or crawling, without our express written consent.

5. SITE TRANSACTIONS & PRODUCT ACCURACY We reserve the right to limit or cancel quantities purchased per person, household, or order. We attempt to display product colors and descriptions as accurately as possible; however, we do not warrant that product descriptions or other content are 100% accurate, complete, reliable, or error-free. If a product is not as described, your sole remedy is to return it in unused condition.

  • Resale Prohibited: You may purchase products for personal use only. Resale of SUGARED + BRONZED products on third-party platforms (e.g., Amazon, eBay, Poshmark) is strictly prohibited and violates this license.

6. SMS MOBILE MESSAGING TERMS By opting into the SUGARED + BRONZED mobile messaging service (the “Service”), you agree to receive recurring automated promotional and personalized marketing text messages (e.g., cart reminders, appointment reminders) from us at the cell number used when signing up. Consent is not a condition of any purchase.

  • Frequency: Message frequency varies.

  • Cost: Message and data rates may apply.

  • Carriers: The Service is available on most major carriers. Carriers are not liable for delayed or undelivered messages.

  • Cancellation: Reply STOP to any message to cancel. You may receive a final confirmation text.

  • Help: Reply HELP for assistance or contact customerservice@sugaredandbronzed.com.

7. COPYRIGHT COMPLAINT POLICY (DMCA) If you believe your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the written information specified below (per 17 U.S.C. § 512):

  1. Signature of the person authorized to act on behalf of the owner of the copyright interest;

  2. Description of the copyrighted work that you claim has been infringed;

  3. Description of where the material is located on the Site;

  4. Your address, telephone number, and email address;

  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

8. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, THIS SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL SUGARED + BRONZED, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

9. INDEMNIFICATION You agree to indemnify, defend, and hold harmless SUGARED + BRONZED and its affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

10. DISPUTE RESOLUTION: MANDATORY ARBITRATION & CLASS ACTION WAIVER Please Read This Section Carefully.

  • Mandatory Arbitration: Any dispute or claim relating in any way to your use of the Site, products, or services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

  • Class Action Waiver: We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

  • Jury Trial Waiver: If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

11. GOVERNING LAW & VENUE These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Site shall be instituted in a state or federal court in Los Angeles County, California. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts.

12. SEVERABILITY If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
