Membership Terms
MEMBERSHIP TERMS & CONDITIONS
1. BILLING & AUTOMATIC RENEWAL
- Recurring Billing: By signing below, you authorize SUGARED + BRONZED to charge your credit card on file the membership fee on a monthly basis.
- Automatic Renewal: This membership is a continuous subscription. It will automatically renew on a month-to-month basis until you cancel.
- Payment Failure: If your primary card fails to charge, you authorize us to bill any secondary payment method on file. If payment cannot be collected, your membership benefits will be suspended immediately.
- Rate Changes: We reserve the right to amend membership rates. You will be notified at least 7 days in advance of any price increase.
2. MEMBERSHIP BENEFITS & EXPIRATION
- Usage: Benefits are valid for services of equal or lesser value. They have no cash value and cannot be redeemed for cash or products.
- Rollover & Expiration:
- Unused benefits roll over month-to-month.
- 12-Month Cap: Any accrued benefit not used within 12 months of issuance will expire.
- Freeze Status: You may freeze a membership for up to 3 months. Accrued benefits cannot be redeemed while a membership is "Frozen" or "Past Due."
- Termination: Upon cancellation/termination of the membership, all unused/accrued benefits expire immediately. It is your responsibility to use your credits before your cancellation date.
- Non-Transferable: Memberships are for the individual named on the account only and cannot be shared or transferred to another person.
3. CANCELLATION POLICY
- How to Cancel: You may cancel your membership at any time after the first two billing cycles You may cancel via the online portal or app.
- No Refunds: Except as required by applicable state law, cancellation becomes effective at the end of the current billing cycle. No refunds will be issued for partial months or unused time.
4. APPOINTMENT & CONDUCT POLICIES
- No-Show / Late Cancel: If you do not show up for a scheduled appointment or cancel with less than 2 hours' notice, you will forfeit your membership benefit for that service (or be charged the standard cancellation fee, at SUGARED + BRONZED's discretion).
- Availability: Appointments are subject to availability. Being a member does not guarantee a specific time slot; advance booking is strongly recommended.
- Code of Conduct: We maintain a respectful environment. Any behavior deemed inappropriate, abusive, or threatening toward staff or other clients will result in immediate termination of your membership without refund.
5. LEGAL & LIABILITY
- Limitation of Liability: Our liability to you is limited to the amount of the membership fee paid. We are not liable for indirect, incidental, or consequential damages except as required by law.
- Privacy: By agreeing to these terms, you consent to the collection and use of your data as outlined in our Privacy Policy.
- Governing Law: These terms are governed and construed in accordance with the laws of the State in which this specific SUGARED + BRONZED location visited by the Client is situated, without regard to its conflict of law principles.
- Dispute Resolution and Class Action Waiver:
- 1. Binding Arbitration: Any dispute or claim arising out of or relating to this Agreement or your Membership shall be resolved by binding arbitration administered by the American Arbitration Association (AAA), rather than in court.
- 2. Class Action Waiver: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims.
- 3. Exception (California "McGill" Clause): Notwithstanding the above, you or the Company may bring a claim in court seeking public injunctive relief (a court order to stop illegal behavior) if such a remedy is not available in arbitration.
- 4. 30-Day Opt-Out Right: You have the right to opt out of this Arbitration and Class Action Waiver provision. To do so, you must send a written notice to customerservice@sugaredandbronzed.com within 30 days of your initial sign-up, stating your name and intent to opt out. If you do not opt out, you are bound to arbitrate disputes individually.
6. MANDATORY ACKNOWLEDGEMENT (Auto-Renewal)
By signing this Agreement, I acknowledge that this membership automatically renews every month and that my credit card will be charged monthly until I cancel online. I accept the Cancellation Policy and understand that unused credits expire immediately upon termination.
